1. Agreement to Terms
By accessing or using our website, mobile application, or any other services provided by Shah Biryani ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. The Service
Shah Biryani provides an online platform for ordering pre-curated meal boxes ("Products"). The Service includes order processing, payment facilitation, and coordination of delivery. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available, inaccuracies in product or pricing information, or issues identified by our fraud avoidance department.
3. User Accounts
You may be required to register for an account to use certain features of the Service. You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for all activities that occur under your account and for safeguarding your password.
4. Orders, Payments, and Billing
All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. We use a third-party payment processor to bill you through a payment account linked to your account. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms.
5. Cancellation and Refund Policy
Due to the perishable nature of our Products, orders cannot be canceled once they have been confirmed and are in the "preparation" stage. Refund requests for issues related to food quality, incorrect items, or delivery problems must be submitted through the app or customer support within a reasonable time (e.g., 2 hours) of delivery. All refunds or credits are issued at the sole discretion of Shah Biryani.
6. Intellectual Property
The Service and its original content, features, and functionality, including but not limited to all text, graphics, logos (specifically the Shah Biryani name and emblem), and software, are and will remain the exclusive property of Manaspurti ("Shah Biryani") and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Shah Biryani.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Shah Biryani, its affiliates, directors, or employees, be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, arising out of or in connection with your use of the Service.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Panaji, Goa.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
